GENERAL TERMS AND CONDITIONS SAFARI DIVING S.L.


1.Definitions


Safari Diving S.L is Safari Diving S.L. and/or (one of) the employees. Safari Diving is situated in Paseo de la Barrilla 4, 35510 Puerto del Carmen, Lanzarote, Spain. The NIF number of Safari Diving is B-35822758. The website is: www.safaridiving.com.
Participant is the person doing the course, program or other activity organized by Safari Diving S.L.
Activity is a course or program that needs to be booked. These can be dive related and non-dive related courses.

2. Reservation

A reservation for an activity with Safari Diving S.L. can be made through the website www.safaridiving.com, by e-mail at info@safaridiving.com or directly at the dive centre unless otherwise agreed with Safari Diving S.L.
A reservation for an activity with Safari Diving S.L. can be denied or cancelled by Safari Diving S.L. at any moment if the participant has a demonstrably lower level than needed for the activity. If the participant has already paid for the activity in advance, Safari Diving S.L. will refund the payment less the deposit.

3. Payments

Payments/deposits may be made via the online booking system immediately upon reservation.

4. Prices

All prices mentioned are in euros and include VAT (Value Added Tax, called IGIC in the Canary Islands).
Safari Diving S.L. can change prices at any given moment without prior notice. Price changes are valid from the moment they are published on the website. These will not affect agreements made prior to the price changes.

5. Participation

Participants take part in the activity of Safari Diving S.L. at their own risk and therefore are:

Required to comply with all instructions of Safari Diving S.L.
Required to dive within the limits of his or her dive license.
Required to adhere to local laws and regulations.


2. Minors
Minors may participate in activities at Safari Diving S.L. provided this is allowed by specific training standards.
A parent/guardian must give permission to participate in the activity in question. Permission is evident from co-signing forms required by training standards.

6. Cancellations
Cancellation of a booking by the participant can be done via the online booking system. If the participant has already paid for the activity in advance, the cancellation will be settled as follows:

Participant cancellation is less than 48 hours before the start of the excursion, we refund the deposit minus 20 euro administration costs.
Participant cancellation is shorter than 24 hours before the start of the excursion, we keep the total deposit and no refund is given.

Cancellation of the activity by Safari Diving S.L. is allowed at any moment in case of an act of God on the side of Safari Diving S.L. such as:

Extreme weather conditions or chance hereof;
Damage to or theft of materials required for the activity;
Death of an employee of Safari Diving S.L.;
When the safety of the participant or an employee is compromised.


If cancellation is done by Safari Diving S.L the total deposit is refunded to the client

7. Cancellation during the excursion
Safari Diving S.L does not refund any money if a diver stops the dive before the end of the tour. We only refund if there is a cancellation because of weather or damage to the rental equipment of Safari Diving S.L. For example, we cannot refund if the diver cannot equalize, has fear, etc etc. After you agreed to the medical questionnaire in the online booking we do not refund any money for medical reasons.


8. Validity

The general terms and conditions of Safari Diving S.L. apply to all agreements with Safari Diving S.L.
These general terms and conditions apply from the 1st of January 2014. Safari Diving S.L. may modify these terms at any time. Previously published general terms and conditions are no longer valid from then on.
If a participant does not accept a change in the general conditions, he or she may cancel the agreement.

9. Governing law

All agreements and quotations shall be governed by Spanish law only.
The parts are subjected to the courts of Lanzarote

10. Privacy statement

We may collect personal identification information from users via our online booking system and via e-mails to info@safaridiving.com. Users may be asked for names and email addresses. Users may, however, visit our site anonymously. We will collect personal identification information from users only if they voluntarily submit such information to us.

How do we use collected information?
Safari DIving may collect and use users personal information for the following purposes:
- To improve customer service: Information you provide helps us respond to your customer service requests and support needs more efficiently.
- To run a promotion, survey or other Site feature: To send users diving related information about topics we think will be of interest to them.
